Johnny brings 25+ years of experience developing complex litigation matters for trial. His interrogating intellect and relentless focus are well known. Johnny graduated summa cum laude from Vanderbilt University (top 1% of his class) in History with Honors. He was Phi Beta Kappa and published an honors thesis regarding the Civil Rights Movement called, “A Breach in the Wall.” Johnny then attended the University of Virginia School of Law, where he excelled in his pursuit of a Doctor of Jurisprudence, before moving to Texas in 1999.
Johnny began his career in the Litigation Section of Vinson & Elkins, where he worked on both large litigation teams and small trial teams. He honed his legal research and writing skills under the guidance of exacting mentors. Johnny’s intense training at V&E included the 2-week NITA trial course in Colorado, where Johnny solved the model case in a way never done before. Johnny was involved in taking over 100 depositions. Much of his practice was on the tort defense side of the docket.
After five years at V&E, Johnny found more courtroom experience on the frontlines of high dollar, complex commercial litigation cases working for Paul J. Dobrowski. Johnny made over 50 courtroom appearances. He was tasked with developing innovative and fresh ideas on these cases. In one major trial victory, Johnny’s third-party witness (subpoenaed by the local sheriff on a boat in Charleston, South Carolina’s harbor after a disputed letters rogatory victory) was the last evidence the jury heard before returning a stunning verdict against clients represented by two of the most renowned commercial litigation firms in Texas.
With two young children at home, Johnny Day started his own firm in the Houston Heights expanding his practice into plaintiffs’ personal injury work. Working with Roberts Markland LLP, Johnny obtained a $4 million verdict in a shoulder injury case, when the pre-trial offer was only $40,000. That case was affirmed by the Fifth Circuit. Johnny also handled intellectual property cases including high value confidential settlements and a $20 million federal court verdict with RM. In total, Johnny has first-chaired and been a part of winning trial teams on more than 10 cases that have reached verdict.
Adjunct to his trial practice, Johnny has developed experience with appeals, including the filing of two briefs in the highest courts in Texas.
Johnny also has experience on the bench. He has served for more than 10 years as a FINRA arbitrator. This experience has included being a panel member on 3 different arbitrations involving $1,000,000+ in controversy that reached judgment.
Johnny’s most recent verdict was announced in 2024. He was the lead lawyer on a team that won a unanimous, clear and convincing million dollar verdict here in Harris County. The confident defendant had offered nothing before trial.
In his spare time, Johnny is an avid reader and movie goer. His favorite lawyer books are Lawyer: My Trials and Jubilations by Joe Jamail and The Man To See by Evan Thomas. Johnny’s favorite lawyer movie is “The Verdict,” starring Paul Newman.
Johnny has written many private circulation papers including “The $11 Billion Verdict: Pennzoil v. Texaco” and “Surviving Civil Voir Dire.” He is currently working on a book called What’s Good for the Goose, a study of equitable principles cited in published court opinions across the nation.
